Old Convictions Keep Coming Back to Haunt You
An old criminal conviction hangs over your head in many ways.
For instance, a tainted record hurts your reputation and community standing. Even more seriously, a past offense sets you back economically by making it harder to be approved for rental applications and to get hired for jobs.
The only way to really escape a prior conviction is to not have one in the first place. Thankfully, while you can’t go back in time, you can still have most types of prior convictions expunged from your record. That’s where clearing your criminal record in Pierce County comes into play.
Who Is Eligible to Have a Conviction Expunged?
If you live in Pierce County, expungement of your record carries two major conditions and one major exclusion:
- First, there is a time period that must pass before you can have a conviction expunged. This ranges from three to 10 years, depending on the specifics of your conviction. During this time, you cannot have any new convictions, and you can’t have any pending charges when you apply for the expungement. If you do not meet this requirement, the waiting period must start over.
- Second, you must carry out all of the orders the court imposed upon you. These often include fines or restitution, community service, and completing a period of probation.
- Lastly, your conviction cannot have been for a Class A felony or a serious crime against another person. It isn’t possible for you to expunge these unless you were convicted as a juvenile..
Does Expunging Your Criminal Record Restore Lost Firearm Rights?
No, expungement does not restore firearm rights. If a court took away your right to possess a firearm in the State of Washington, including in Pierce County, expungement of any prior convictions will not have any effect on that. The state law governing firearm possession is RCW 9.41.040. You must comply with the terms laid out there.
However, this is an area where Findley & Rogers can help you. See our Firearm Rights Restoration page.
